Use of any and all elements of Q21 Productions and associated websites by any person constitutes such user’s agreement to and acceptance of the following terms and conditions. Users are advised to periodically review this page for any updates and revisions to these terms and conditions.

1, All products, services and content on Q21 Productions, and/or its associated websites, including but not limited to, all text, lyrics, drawings, designs, illustrations, photographs, logos, audio and audiovisual, lyrics, merchandise, computer codes, interfaces, links, and the selection, placement and organization thereof, is owned by or has been licensed (through its purported owner) to Q21 Productions and/or its assignees and licensees and is subject to all relevant copyright, trade-mark, patent and other intellectual property or other proprietary rights throughout the world. No content from Q21 Productions may be copied, reproduced, uploaded, posted, translated, transmitted, encoded, publicly displayed, distributed in any way whatsoever, except by the express written permission of Q21 Productions and/or its assignees. Nothing herein shall be construed to imply any grant of ownership or license of rights to any users in any content on Q21 Productions.

2, Additional terms will apply to those users who use Q21 Productions for permitted commercial or promotional activities, including but not limited to, the purchase of any goods and services available for sale on Q21 Productions, any contest, promotions or other marketing campaigns, and such terms are hereby incorporated into these terms by this reference.

3, The Workshop(s) included on Q21 Productions will require users to follow implicit instructions provided upon registration online or in person. The materials delivered to users email, mailing address or in person at Q21 PRODUCTIONS STUDIOS must be read through thoroughly and acted in accordance with by users. Absenteeism, tardiness, non-preparation or non compliance with workshop prerequisites as a result of negligence by users to comply with workshop instructional details provided by Q21 PRODUCTIONS does not entitle user to full or partial refunding of pre-paid registration fees.

4, Q21 Productions reserves the right to alter its website, and any and all merchandise, products, services, workshops,  programs or other marketing campaigns at any time in its sole discretion. Q21 Productions shall endeavour to keep all of its information and content current, but nothing herein shall obligate Q21 Productions to do so in accordance with any strict guidelines. Q21 Productions reserves the right to limit any content, merchandise or services in any territory or territories and any offer for the same is void where prohibited.

5, Q21 PRODUCTIONS makes no guarantee that the website will run continuously and error-free at all times or that any information, materials or content users distribute on or through Q21 PRODUCTIONS shall remain intact and free from any harm or losses suffered. Q21 PRODUCTIONS, its related companies and affiliates, and each of their respective officers, directors, shareholders, employees, agents, representatives, and volunteers, hereby disclaim any representations and warranties, whether express or implied, relating to any accuracy, merchantability or fitness for any particular purpose, or warranties of title or non-infringement, of any and all content, merchandise, products or services displayed, advertised on or distributed through Q21 PRODUCTIONS, including but not limited to any payment services made available through third party links (i.e.: PayPal.com, Amazon.ca) on Q21 PRODUCTIONS, and any representations and warranties made in the course of any dealings, sale or trade of any such merchandise or services on Q21 PRODUCTIONS, or the use of the website in general. Q21 PRODUCTIONS, its related companies and affiliates, and each of their respective officers, directors, shareholders, employees, agents, representatives, and volunteers do not endorse any particular content, materials or information made available on or through Q21 PRODUCTIONS, and shall not in any way be liable for any claims, demands, injuries, or losses, whether direct or indirect, caused by any acts or omissions by any third party of Q21 PRODUCTIONS, including any instances of tort, including but not limited to, negligence or breach of the terms and conditions of this website (whether in part or in whole) by any third party, or from the transmission, dissemination, or distribution of any content on or through the website. Except where prohibited by law, in no case will Q21 PRODUCTIONS be liable for any indirect, consequential, exemplary, incidental or punitive damages. Q21 PRODUCTIONS, may, in its sole discretion, elect to assume partial or complete control of any action or defense in relation to the foregoing, or refrain from doing so.

6, The sole remedy for any users who do not agree to these terms and conditions shall be to discontinue use of Q21 PRODUCTIONS and its related products or services. Q21 PRODUCTIONS is under no obligation to return any materials or content to any user at any time. Any and all representations and warranties made by any user, whether express or implied, shall nevertheless survive any such discontinuance of Q21 PRODUCTIONS.

7, The rights of Q21 PRODUCTIONS, its related companies and affiliates, and each of their respective officers, directors, shareholders, employees, agents, representatives, and volunteers, as set forth in these terms and conditions, are in addition to any copyright, trade-mark rights, proprietary rights, or any other rights created by statute, common law, rule or regulation, and nothing herein is intended to waive or reduce any such rights. These terms and conditions are governed by the laws of the Province of Ontario and the federal laws of Canada, as applicable, without reference to any conflict of laws principles. No waiver of any terms or conditions contained herein or in any other terms and conditions posted on Q21 PRODUCTIONS by Q21 PRODUCTIONS, its directors, officers, shareholders, employees, agents or representatives, or any user of Q21 PRODUCTIONS shall be construed as a waiver of any preceding or subsequent breach of such terms and conditions. If any one term or condition contained herein is found to be unenforceable in a court of competent jurisdiction, the remaining terms and conditions herein shall nevertheless remain in full force and effect.
